Under Mississippi Rule of Civil Procedure 4(c), any person who is not a party to the action and is at least 18 years old may serve process. Proper service ensures defendants receive constitutionally required notice of legal actions against them.

Mississippi Rules of Civil Procedure Rule 4 governs service of process. After a lawsuit is filed, the plaintiff must serve the defendant with a summons and copy of the complaint. Service may be accomplished by personal delivery, by leaving documents at the defendant's dwelling with a person of suitable age and discretion, or by other methods authorized by the court. This supports a motion for service by publication under Mississippi Code Section 13-3-31.

A Return of Service (also called Proof of Service) is a sworn affidavit signed by the process server detailing exactly how, when, and where legal documents were served. It includes the date and time of service, the address, a physical description of the person served, and the method of service. Our returns include GPS coordinates and timestamps for added verification. This document is filed with the court as proof of proper service.

Yes. Mississippi law permits personal service at any location where the defendant can be found, including their workplace. Our process servers exercise professional discretion when serving at places of employment, requesting the individual by name without disclosing the nature of the documents to coworkers or supervisors.

Under Mississippi law, physical acceptance is not required for valid service. If the process server identifies the individual and informs them of the nature of the documents, the papers can be placed in the person's immediate proximity. This constitutes valid personal service even if the individual refuses to physically take the documents.

Our standard operating hours are Monday through Saturday, 7:00 AM to 7:00 PM Central Time. Evening and weekend service attempts can be arranged for an additional fee, and are often the most effective strategy for individuals who are difficult to locate during regular business hours.

Yes. All Mississippi Process Service LLC agents carry professional liability insurance and are bonded. Our servers are experienced professionals trained in Mississippi civil procedure, proper identification techniques, and professional conduct during service attempts.

Personal service means the documents are handed directly to the named defendant. Substituted service (also called abode service) means the documents are left at the defendant's usual dwelling place with a person of suitable age and discretion who also resides there. Mississippi courts generally prefer personal service, but substituted service is valid under MRCP Rule 4(d)(1)(B). Our process servers always attempt personal service first.
